Persona Informatics (“Company”) respects the privacy of individuals (“Participants”) who participate in our Remote Monitoring Program (“Program”). This Privacy Policy describes how we collect, use, disclose, and protect Participant data within the Program.
2. Information We Collect
We collect and process the following Participant data through the Program:
- Device-collected data: Includes vital sign measurements (such as heart rate, blood pressure, weight, oxygen saturation, and body temperature), activity levels, sleep information, and other similar data from supported home devices or apps.
- Personal information: May include name and contact information as needed to support delivery to health information systems.
- Program usage data: Includes device usage timestamps and technical information about device models, API versions, measurement tolerances, and other related information about devices or apps.
3. How We Use Participant Data
We use Participant data solely for the following purposes:
- To facilitate remote monitoring and transmit data to Participant’s Doctor.
- To improve the Program’s effectiveness and functionality.
- To comply with legal and regulatory requirements.
- To communicate with Participants regarding the Program and provide technical support.
4. Data Sharing and Disclosure
We may share Participant data that identifies you with:
- your Doctor and other healthcare professionals involved in your care;
- third-party service providers who help us operate the Program and who are contractually required to protect your data and use it only for the purposes we specify;
- law enforcement, regulators, or others where required or authorised by law.
We do not sell, rent, or lease Participant data that identifies you.
De-identified and aggregated data. We may create de-identified, anonymised, or aggregated datasets from Participant data — information from which identifiers have been removed or altered so that it no longer identifies, and cannot reasonably be used to re-identify, any individual. We de-identify such data to a standard designed to meet or exceed the requirements of the data protection and health-information laws applicable in the jurisdictions in which we operate, including:
- the United States: the de-identification standard under HIPAA (45 CFR §164.514), together with applicable state privacy laws;
- Canada: the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws;
- Australia: the Privacy Act 1988 (Cth) and the Australian Privacy Principles; and
- New Zealand: the Privacy Act 2020 and the Health Information Privacy Code 2020.
We may use, share, license, or sell de-identified, anonymised, or aggregated data to third parties, including for research, population-health, analytics, and commercial purposes. We do not attempt to re-identify this data, and we contractually prohibit recipients from attempting to re-identify it or to combine it with other data to identify any individual.
5. Data Security and Protection
We implement industry-standard security measures to protect Participant data, including:
- Encryption of data at rest and in transit.
- Access controls to limit data access to authorized personnel.
- Regular security audits and vulnerability assessments.
6. Data Retention
We retain Participant data for the period required by law or regulation as well as for the duration of the remote monitoring program as determined by the Participant’s Doctor and authorized healthcare professionals.
7. Participant Rights
Participants have the following rights regarding their data:
- Access and review their data.
- Request correction of inaccurate data.
- Opt-out of the Program and request data deletion.
